(AP) — A federal judge in Oregon ruled Friday that President Donald Trump’s administration failed to meet the legal requirements for deploying the National Guard to Portland after the city and state sued in... The ruling from U.S. District Court Judge Karin Immergut, a Trump appointee, followed a three-day trial last week in which both sides argued over whether protests at the city’s U.S. Immigration and Customs Enforcement building met the conditions for using the military domestically under federal law. The administration said the troops were needed to protect federal personnel and property in a city that Trump described as “war ravaged” with “fires all over the place.”

Friday’s injunction offers a much more detailed examination of the law and conditions in Portland leading up to Trump’s Sept. 27 authorization of Guard members to protect the U.S. Immigration and Customs Enforcement building in the South Waterfront neighborhood amid nightly protests. She found that Trump failed to meet the two criteria he used to invoke federal code to mobilize the National Guard: there was no danger of a rebellion against U.S. government authority, Immergut ruled, and officers have not been thwarted from executing federal law. The decision was a long-awaited ruling in a case that catapulted Portland into the national spotlight. Immergut’s ruling is a permanent injunction against the U.S. Department of Defense and Secretary Pete Hegseth, as well as the Department of Homeland Security and Secretary Kristi Noem, banning them from carrying out recent plans to send troops to Portland. The ruling found that the federal government’s decision to briefly deploy unlawfully federalized troops to Oregon early last month violated US code and the Tenth Amendment of the Constitution. The ruling also found that “Oregon has suffered irreparable injury from the unlawful federalization and deployment of both its own National Guard and the National Guards of other states.” “Lastly, there are no adequate remedies available at law, and the balance of hardships and the public interest favor Plaintiffs,” the ruling states.
Immergut made it clear that the court’s ruling “does not rule that the President can never deploy the National Guard to Oregon, or to any other location, if conditions on the ground justify the... National Guard troops cannot be deployed in Portland and President Donald Trump exceeded his authority by attempting to do so, a federal judge ruled Nov. 7. Immergut ruled that the government didn't meet the threshold for declaring recent ongoing protests outside an ICE facility in Portland a rebellion. She noted in her ruling that the Portland Police Bureau's 812 officers are trained in crowd management and First Amendment law. She also noted their mutual aid agreements with neighboring law enforcement agencies, as well as with the Oregon State Police and federal law enforcement, signaling that they had protests well in hand. "If additional resources beyond all of these are critically needed, PPB may request that Oregon's Governor provide National Guard resources for a locally declared emergency," she wrote. Since July, the judge's ruling said, the protests generally were limited to fewer than 30 people and were "largely sedate."
